Agreement to terms and conditions
The following terms and conditions apply to the Fraser Health Authority Food Services Eyáleq’ep Reward Card Program (the “Eyáleq’ep Reward Card Program”), the use of any physical Eyáleq’ep Reward Card (including a physical card uploaded to your digital wallet) (a “Physical Eyáleq’ep Reward Card”), any digital Eyáleq’ep Reward Card (a “Digital Eyáleq’ep Reward Card”), and any physical or electronic gift card (a “Gift Card”). In this Agreement, we refer to Physical Eyáleq’ep Reward Cards, Digital Eyáleq’ep Reward Cards, and Gift Cards collectively as a “Eyáleq’ep Reward Card.”
The terms “Fraser Health,” “Eyáleq’ep Reward Card Program,” “us,” “we,” or “our” refer to Fraser Health Authority, which owns all of the rights to the Eyáleq’ep Reward Card Program. The term “you” or “your” refers to a user of a Eyáleq’ep Reward Card.
These terms and conditions, including the Eyáleq’ep Reward Card Program Privacy Policy, (the “Agreement”), is a binding legal contract between you and Fraser Health. Please read this Agreement carefully before buying, loading, or using a Eyáleq’ep Reward Card. Do not click “agree”, and do not buy, load, accept, or otherwise use a Eyáleq’ep Reward Card if you do not accept the terms of this Agreement.
We may change this Agreement from time to time without specific notice to you by updating the Agreement posted on this website. Your use of the Eyáleq’ep Reward Card after the changes are posted means you accept the terms of the modified Agreement.
Purchasing Eyáleq’ep Reward Cards
You may pay for Eyáleq’ep Reward Cards using a valid debit card or valid credit card (Visa, Master Card, American Express). You may use cash to purchase Physical Eyáleq’ep Reward Cards and physical Gift Cards on-site only at participating Fraser Health Eyáleq’ep retail food facilities. You may not load less than $1.00 or more than $100.00 on your Eyáleq’ep Reward Card at any time. Your Eyáleq’ep Reward Card will not expire.
Registering your Reward Card
Please see the Eyáleq’ep Privacy Policy for information about the information collected when you choose to register your Eyáleq’ep Reward Card on our Eyáleq’ep Reward Card Program. If you do register your Eyáleq’ep Reward Card on our Eyáleq’ep Reward Card Program, you are responsible for maintaining the confidentiality of your user name and password for all Eyáleq’ep Reward Cards using that password.
Reward points
When you use your Eyáleq’ep Reward Card for authorized reward point purchases, you may be eligible to accumulate Eyáleq’ep reward points. You may redeem reward points only for food and beverages at participating Fraser Health Eyáleq’ep retail food locations. For each $1 spent using your Eyáleq’ep Reward Card, you will accumulate one (1) reward point. One hundred (100) reward points is equivalent to $3 off a subsequent purchase. Your reward points will not expire but you will need your 16-digit Eyáleq’ep Reward ecard number to be able to redeem them. There is no limit on the number of reward points that can be accumulated on a Eyáleq’ep Reward Card.
No refunds
Your Eyáleq’ep Reward Card is like cash and you should protect it as you would protect your cash. We will not refund you any funds or reward points for a lost, stolen, or damaged Eyáleq’ep Reward Card or for any lost or stolen reward points.
Prohibited activities
You may not use the Eyáleq’ep Reward Cards or Eyáleq’ep Reward Card Program in any way that may harm us, the Eyáleq’ep Reward Card Program or anyone one else, including other users of the Eyáleq’ep Reward Card Program. This includes: misrepresenting your identity, use of another user’s Eyáleq’ep Reward Cards without permission, unauthorized access to other users’ information, use of any device, software or program to interfere with the Eyáleq’ep Reward Card Program or breach the security of any system, device or network associated with the Eyáleq’ep Reward Card Program.
No warranties
Fraser Health makes no representations, express or implied, and disclaims all expressed and implied warranties, and conditions of any kind relating with respect to Eyáleq’ep Reward Cards or the Eyáleq’ep Reward Card Program, including without limitation, representations, warranties or conditions regarding accuracy, timeline, completeness, non-infringement, merchantability or fitness for any particular purpose. Fraser Health is under no obligation to provide any maintenance or customer support for the Eyáleq’ep Reward Card Program website.
Fraser Health is not responsible to a user of the Eyáleq’ep Reward Card Program or any third party for the consequences of any errors or faults in the Eyáleq’ep Reward Card Program or the Eyáleq’ep Reward Card Program website. Your use of the Eyáleq’ep Reward Card Program and the Eyáleq’ep Reward Card Program website is solely at your own risk.
To the maximum extent permitted by applicable law, by buying, loading or using a Eyáleq’ep Reward Card, you hereby: (i) release Fraser Health, its officers, directors, employees, representatives, contractors, agents, successors and assigns (collectively, the “Released Parties”) from any loss, liability, claim, demand, damage or expense that arises in connection with your Eyáleq’ep Reward Card; and (ii) agree to accept all responsibility for, and agree to indemnify, defend and hold harmless the Released Parties from and against any loss, liability, claim, demand, damage or expense asserted by any entity or person relating in any way to your breach of any of this Agreement or that may arise from actions taken by you or for any unauthorized access to, use or misuse of your Eyáleq’ep Reward Card or of the Eyáleq’ep Reward Card website. Without limiting the generality of the foregoing, the Released Parties are not responsible for: (a) late, lost, misdirected, delayed, incomplete or incompatible Eyáleq’ep Reward Card-related Information; (b) any failure of a Eyáleq’ep Reward Card, the Eyáleq’ep Reward Card website or any other Eyáleq’ep Reward Card-related software, hardware or other type of system; (c) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, electronic transmission, computer on-line systems, servers, access providers, computer equipment or software, any inability to access the Eyáleq’ep Reward Card website or other on-line service, the failure of any information to be received, or for any other technical or non-technical error or malfunction; (d) any injury or damage to your or any other person’s computer, mobile device, tablet or other device related to or resulting from the purchase or use of a Eyáleq’ep Reward Card; (e) incorrect or inaccurate transcription of information or any human error or printing error; and/or (f) any combination of the above. Neither are the Released Parties responsible for any Eyáleq’ep Reward Cards that are undeliverable, not received, or claimed by someone other than the intended recipient, whether due to failure to enter an accurate physical address or email address for the recipient at the time of purchase, or due to a recipient’s spam filter, firewall or email capacity, or otherwise.
Limitation of liability
Neither Fraser Health, any content owner or third party licensor, nor their respective directors, officers, employees, agents, or contractor will be liable to you and/or to any third party under any circumstances for any damages of any kind arising or any losses of any kind arising out of or relating to your use of, or your ability or inability to access or use, or reliance upon, your Eyáleq’ep Reward Card, the Eyáleq’ep Reward Card Program, or the Eyáleq’ep Reward Card Program website, including, but not limited to, monetary, or physical. Fraser Health will use and protect the personal information you provide in connection with your use of your Eyáleq’ep Reward Card Program, in accordance with the Eyáleq’ep Reward Card Program privacy policy which forms part of this Agreement and is located here.
Intellectual property
The materials on the Eyáleq’ep Reward Card Program website and the Eyáleq’ep Reward Cards are protected by copyright, trademark and other forms or proprietary rights and are owned or controlled by Fraser Health, or used with permission.
Termination
This Agreement is governed by the laws of British Columbia and the applicable laws of Canada, and constitutes the entire and only agreement between us and you with respect to the Eyáleq’ep Reward Card Program. This Agreement supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Eyáleq’ep Reward Card Program, Eyáleq’ep Reward Card Program website the content, products or services provided by or through the Eyáleq’ep Reward Card Program or the Eyáleq’ep Reward Card Program website, and the subject matter of this Agreement. We may terminate the Eyáleq’ep Reward Card Program, or suspend or terminate your access to the Eyáleq’ep Reward Card Program, at any time in our sole discretion.
